1. Agreement to These Terms
By creating an account, placing an order, or otherwise using the Harvest Clean Food website, mobile experience, or meal-delivery service (together, the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.
If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Harvest Clean Food (registered in Thailand). Questions? Email [email protected].
2. Account Registration and Security
You do not need an account to place a single order, but creating one lets you track orders and earn loyalty points. When you create an account, you agree to:
- Provide accurate, current, and complete information (name, email, phone number, delivery address) and keep it up to date.
- Keep your login link / session token confidential and not share it with others.
- Notify us immediately at [email protected] if you suspect unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account, including orders placed and payments made.
We use a magic-link, password-free login for security. Login links expire after 15 minutes and are single-use. We will never ask for your password by phone or email.
3. Orders, Prices, and Payment
3.1 Ordering
Harvest Clean Food operates on a one-time-order basis only — we do not offer subscriptions, weekly plans, or recurring billing. Each order is a single, independent purchase.
An order is confirmed when you receive an order confirmation email and a payment authorization succeeds. We reserve the right to decline or cancel an order if we are unable to fulfill it (e.g. a menu item becomes unavailable) — in which case we will issue a full account credit or process a refund within 3 business days at your option.
3.2 Order Cutoff
Orders must be placed by 12:00 PM (noon) Bangkok time on the day before your chosen delivery date. Orders received after the cutoff will be scheduled for the next available delivery date, and we will confirm the new date by email.
3.3 Prices
Prices are shown in Thai Baht (฿) and include applicable VAT unless stated otherwise. Delivery fees apply to orders under ฿999 (currently ฿89). Prices may change. The price shown at the time you complete checkout is the price you pay for that order — no recurring charges will ever be made automatically.
3.4 Payment Methods
We accept Visa, Mastercard, American Express, and PromptPay. All card transactions are processed by Omise Co., Ltd. (PCI DSS Level 1 certified). We do not store card numbers, CVV codes, or expiry dates — only the payment token issued by Omise.
3.5 Failed Payments
If a payment fails, your order will not be processed and you will be notified by email. You may re-submit your order with a different payment method. No charge is made unless a payment fully succeeds.
4. One-Time Orders — Changes and Cancellations
Because Harvest Clean Food is a one-time-order service, there are no subscriptions, skip weeks, pause states, or renewal cycles. Each order stands alone.
You may cancel or modify your order (change meals, quantities, delivery date, or address) free of charge up to 12:00 PM (noon) Bangkok time on the day before your scheduled delivery. Example: for a Tuesday delivery, contact us by Monday at noon.
Cancellation or modification requests received after the cutoff cannot be accommodated, as ingredients have already been sourced and preparation has begun. To cancel or change an order, message us at [email protected] with your order number.
5. Delivery and Safe Receipt
We deliver to the Bangkok districts and Pattaya areas listed at harvestcleanfood.com/how-it-works. If your address is outside our current delivery zones, we will notify you before processing payment.
You are responsible for ensuring that someone is available to receive the delivery within your chosen time window (Morning 8–11 AM, Midday 11 AM–2 PM, or Afternoon 2–5 PM), or for providing a specific safe-drop location (security desk, lobby, building office). We are not liable for meals that are left unattended after a successful delivery confirmation.
Once delivered, refrigerate your meals immediately. Meals are best within 6 days of delivery when kept refrigerated. Meals left outside a cold chain for extended periods should be discarded. We are not responsible for meals that deteriorate due to improper storage after delivery.
6. Allergens and Dietary Requirements
Our kitchen handles common allergens including gluten, dairy, soy, eggs, peanuts, tree nuts, fish, and shellfish. While we take care to prevent cross-contact, we cannot guarantee an allergen-free environment. Customers with severe or life-threatening allergies should consult a medical professional before ordering and contact us directly at [email protected] to discuss your specific needs.
Allergen information displayed on each meal card is provided in good faith based on ingredient lists from our suppliers. We are not liable for reactions caused by undisclosed ingredient changes by third-party suppliers, provided we update our meal cards as soon as we become aware of any change.
7. Sales Policy — All Sales Are Final
Because our meals are fresh, perishable, and prepared to order, all sales are final. We do not offer cash refunds for change-of-mind cancellations, dissatisfaction with flavour preferences, or requests made after the order cutoff.
We recognise that genuine issues can occur. Where a problem is clearly our fault, the remedy is:
- Non-delivery due to our error — we will reschedule your delivery to the next available date at no charge, or issue a full account credit at your option.
- Serious quality issue (spoiled, severely damaged, or completely wrong meal) reported within 2 hours of delivery with photographic evidence — we will offer a rescheduled replacement delivery or an equivalent account credit.
Account credits do not expire and can be applied to any future order. Full details are in our Refund Policy.
No remedy — credit or replacement — is available if: the meal was consumed beyond inspection (more than 25% eaten), the issue is reported after 2 hours, or the problem arose from improper storage by the customer.
8. Intellectual Property
All content on the Service — including recipes, photography, nutritional data, copy, branding, design elements, and software — is owned by Harvest Clean Food or its licensors and is protected by Thai and international intellectual property law. You may not copy, reproduce, distribute, publicly display, or create derivative works from any part of the Service without our prior written permission.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
9. Limitation of Liability
To the fullest extent permitted by Thai law, Harvest Clean Food's total liability for any claim arising out of or in connection with these Terms or the Service is limited to the amount you paid us in the three months preceding the event giving rise to the claim.
We are not liable for:
- Indirect, incidental, special, or consequential damages of any kind;
- Loss of profit, revenue, data, goodwill, or business opportunity;
- Damages arising from your failure to follow storage instructions;
- Delays or non-delivery caused by force majeure events (including natural disasters, widespread infrastructure failure, or government orders).
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded or limited under applicable Thai law.
10. Changes to These Terms and Governing Law
We may update these Terms from time to time. Material changes will be posted on this page with a new “last updated” date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of Thailand. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
